Injuries Caused By Workplace Violence

Injured2

Every year, millions of people across the United States are injured by workplace violence. In 2018, over 20,000 injuries and more than 450 deaths were reported as a result of workplace violence. Victims of these types of assaults have legal options, including collecting the compensation that they deserve for their injuries. If you or a loved one has suffered injuries as a result of workplace violence around the Delray Beach area, the experienced and compassionate personal injury attorneys at Earnhart Law are here to help. Call or contact us today to schedule a free consultation to learn more about your legal options.

Types of Workplace Violence

There are four main types of workplace violence that typically occur: criminal intent violence, customer/client violence, worker on worker violence, and violence that stems from personal relationships. The last category overwhelmingly targets women, and some types of professions are more likely to be subject to injuries caused by workplace violence. For example, taxi drivers are twenty times more likely than the average worker to suffer fatal injuries on the job as a result of workplace violence, but healthcare workers, service providers, and education workers are also more likely to be hurt because of violence in the workplace.

The National Safety Council recommends keeping an eye out for the following warning signs that may indicate the possibility of workplace violence, which includes the following:

  • Excessive drug or alcohol use,
  • Unexplained absences, changes in behavior, or declines in job performance,
  • Depression, withdrawal, or suicidal comments,
  • Resistance to changes at work or persistent complaining about unfair treatment,
  • Violation of workplace policies,
  • Emotional responses to criticism, and
  • Mood swings and paranoia

Compensation for Workplace Violence Injuries

Victims of workplace violence and their loved ones are entitled to compensation after a violent incident that causes serious injuries, or worse. Damages for injuries resulting from workplace violence include coverage of all economic costs, such as medical expenses, lost wages, property damage, and loss of future income and benefits. Compensation also includes payment for noneconomic damages, such as pain and suffering, emotional distress, disability, disfigurement, and the loss of enjoyment of life that is caused by the incident. In fatal cases of workplace violence, the family of the victim can also seek compensation with the filing of a wrongful death claim, which can include damages for all final medical bills, funeral and burial costs, payment for any final pain and suffering of the victim, and for the loss of their love, support, companionship, and guidance.

One of the biggest difficulties in a workplace violence case is determining who is liable for the cost of the victim’s injuries. An experienced lawyer like those at Earnhart Law can help figure out whether the victim’s employer or others may share in the liability for this type of harm.
