What is Considered Negligent Security?

Negligent security is a special type of premises liability claim that involves the acts of a third party on the premises of another person. In order to claim negligent security, the victim of a crime or attack must be able to show that the property owner’s lack of security created a hazardous condition which resulted in the victim’s injuries. There are many different examples of negligent security that allow an attacker to assault or harm unaware guests, including the following:

  • Lack of security guards
  • Lack of security cameras
  • Lack of proper lighting in buildings or in parking lots
  • Broken locks
  • Lack of fencing or holes in fencing
  • Overbooked accommodations, and more.

Injuries Caused by Negligent Security Incidents

The injuries caused by incidents involving negligent security are often more severe than other types of premises liability claims because of the violent nature of the attack.
